EDITORIAL: Continued use of force deepens hatred, division after 9/11 attacks

（社説）９・１１の教訓どこへ　法治より力　深まる憎悪と分断

On Sept. 11, 2001, members of international terrorist group al-Qaida hijacked four passenger jets and flew into the World Trade Center in New York and the Pentagon in Washington, D.C. The attacks killed about 3,000 people.

The first court session for Khalid Sheikh Mohammed, the purported mastermind behind the attacks, and other suspects is scheduled for June 2028, meaning legal proceedings have not started even a quarter-century after the incident.

A prolonged legal battle developed over whether the confessions of the defendants were admissible because they were obtained through secret detention and torture, including waterboarding, conducted by U.S. intelligence agencies.

While the United States called for a war on terrorism, its trampling of the law prevented dispensing justice against suspected terrorists.

■VEERING OFF RULE OF LAW

9/11, an unforgivable criminal act, crushed hopes for peace and stability that had spread after the end of the Cold War.

But Washington has damaged its prestige by tilting toward the use of military power to respond to terrorism.

The past 25 years have been a period in which a superpower injured by terrorism has shaken the rule of law and order through its own actions.

The cooperation and involvement of some nations, such as Britain, Italy and Poland, in the special transfer of terror suspects to other nations without going through normal legal procedures has also been pointed out.

Since 2002, about 800 individuals have been sent to the detention camp at the U.S. Guantanamo Bay Naval Base in Cuba, and 15 are still detained there.

Thoughts of deviating from the law across territorial borders have changed in form but continued to spread.

U.S. President Donald Trump ordered the abduction of the Venezuelan president and his wife. Washington also bombed boats suspected of smuggling under the rubric of fighting drug traffickers.

Battling terrorism should not be used as an excuse to violate the law and human rights.

Amnesty International has pointed out that anti-terrorism and state security laws in Egypt, India and Hong Kong have been used to clamp down on human rights activities and critical views of the government.

In Japan, the designated secrets protection law was enacted.

Now, surveillance cameras are prevalent in the streets of many nations, perhaps reflecting the growing sense that restricting freedom and convenience may be unavoidable if monitoring is meant for safety.

The proper balance between law and order and freedom must be reassessed.

■REBUILD BRAKES ON WAR

In August five years ago, the United States pulled out of Afghanistan, ending 20 years of war there.

The sight of the last U.S. military plane fleeing late at night symbolized the defeat of a superpower and marked a return to power of the Islamic fundamentalist group Taliban.

The Taliban had been ousted from power for protecting al-Qaida.

All countries, with the exception of Russia, do not formally recognize the current Taliban government mainly because it has ignored the rights of women.

The United States expanded its war on terrorism from Afghanistan to Iraq, but that effort failed even after an enormous amount of money was poured in. That should have shown the limits of self-righteously using force.

The Russian invasion of Ukraine, Israel’s onslaught in Gaza and the U.S.-Israel attack on Iran all have no end in sight, even though many innocent civilians have been killed.

In early September, the U.S. military announced a missile attack against an Iranian military facility. But Iran responded that the airstrike killed five people and injured about 70 at a wedding reception.

That recalls the tragedy in 2002 when a U.S. military aircraft mistakenly took a gun salute at a wedding in Afghanistan as an attack and bombed the site, killing dozens of civilians.

The negative spiral of the use of force planting the seed for hatred and leading to terrorism must end.

World War II erupted even after the Treaty of Versailles, with a non-belligerence provision, was agreed to after World War I.

To rectify this, the U.N. Charter banned, in principle, the use of force, except for self-defense or based on a U.N. Security Council resolution.

But the war on terrorism has led to a failure to apply such brakes.

The shock of 9/11 should not be used to abandon the principle of avoiding war as a necessary option.

Now is the time to tighten the loosened reins.

■SEEDS FOR TERRORISM

Al-Qaida has been weakened, and the Islamic State, which emerged from remnants of the terror group, has lost areas in Syria and Iraq it once controlled.

But that does not mean the threat of terrorism has disappeared.

An analysis by the Australian Institute for Economics and Peace shows the epicenter of global terrorism has shifted from the Middle East to western Africa.

Among the factors behind the trend are weak rule, poverty, conflicts over water and land brought about by climate change, and the inflow of weapons.

Upon reflection, al-Qaida was able to sink its roots in Afghanistan after extended fighting and international apathy weakened state functions and created a vacuum.

While force can hurt the terrorist organization and damage its bases, it cannot erase the foundation that led to the creation of the group.

Multilateral cooperation is needed on such issues as education, development, jobs, economic disparity and climate change to prevent the creation of another “forgotten” area.

Terrorism is not caused only by failed nations.

Those involved in the 9/11 attacks received high education, and some lived in the West.

The strengthening of anti-Islam sentiment and xenophobia in Europe could turn young people into ultra-rightists.

The lessons 25 years after 9/11 should be to rebuild international cooperation to protect the rule of law, place brakes on the use of force, and fill in any state vacuums and social division.

２００１年９月１１日、国際テロ組織アルカイダが旅客機４機を乗っ取り、米国の世界貿易センタービルや国防総省を攻撃し、約３千人の命を奪った。テロを首謀したとされるハリド・シェイク・モハメド被告らの初公判は２８年６月。四半世紀を経ても本格審理に至っていない。
　被告らが米情報機関の秘密拘禁や水責めなどの拷問を受け、供述の証拠能力をめぐる争いが長引いた。「テロとの戦い」を掲げた米国が法を踏み越えたことが、テロを法で裁く妨げになった。

■連鎖する法の逸脱
　冷戦後に広がった平和と安定への期待を９・１１は打ち砕いた。断じて許されない犯罪行為だった。だが米国は軍事力による対応に傾斜し、威信を損なう。この２５年間はテロに傷ついた超大国が、その振る舞いで法の支配と秩序を揺るがした時代でもあった。
　テロの容疑者を法的な手続きを経ずに第三国へ送る「特別移送」には、英国、イタリア、ポーランドなどの協力や関与も指摘された。キューバにあるグアンタナモ米軍基地の収容所には０２年以来約８００人が送られ、いまも１５人が収容中とされる。
　国境を越えて法を逸脱する発想は、姿を変え、さらに広がっている。トランプ米政権はベネズエラの大統領夫妻を拉致し、「麻薬との戦い」を名目に密輸船とみなした船を次々と空爆した。
　テロ対策を法や人道の一線を越える免罪符にしてはいけない。国際人権団体アムネスティ・インターナショナルはエジプト、インド、香港などでテロ対策や国家安全保障に関する法律が政府に批判的な言論や人権活動を封じるために使われたと指摘する。日本でも特定秘密保護法などが制定された。
　多くの国の街中に監視カメラがあふれる。「安全」のためなら監視され、自由や利便を制約されても仕方がない。そんな感覚が日常に根づいていないか。治安と自由の均衡を問い直さねばならない。

■戦争の歯止め再建を
　５年前の８月、米国は２０年に及ぶ戦争に見切りをつけ、アフガニスタンから撤退した。深夜、逃げるように最後の米軍機が飛び立つ姿は超大国の敗北を象徴した。
　復権したのは、アルカイダをかくまったとして政権の座を追われたイスラム主義勢力タリバンである。女性の人権軽視などを理由に、ロシア以外から承認されないまま統治を続けている。
　米国はアフガニスタンからイラクへ対テロ戦を広げ、巨額を費やして失敗した。独善を武力で押しつける限界が示されたはずだ。
　ロシアによるウクライナ侵略。イスラエルのガザ攻撃。米国とイスラエルのイラン攻撃。いずれも出口を見いだせていない。多くの民間人が巻き添えになっている。
　９月初め、米軍はイランの軍事施設をミサイルで攻撃したと発表した。イラン側は結婚式場が被害にあい、５人が死亡し７０人以上が負傷したと反論する。
　アフガニスタンで２００２年、結婚式で祝砲をあげているのを米軍機に対する攻撃だと誤認して空爆し、市民数十人が犠牲になった惨事を思い起こさせる。武力行使が新たな憎悪の種をまき、テロを生む。この悪循環を断ち切らなければならない。
　第１次大戦後にパリ不戦条約が採択されながら、第２次大戦は起きた。その反省から国連憲章は武力行使を原則として禁じ、自衛や国連安保理の決議に基づく場合などに限った。だが、対テロ戦で歯止めがかからなくなった。
　９・１１の衝撃ゆえに、戦争を必然の選択肢にしないという理念まで手放して良いはずがない。いまこそ、緩んだたがを締め直すときである。

■土壌なくす協調こそ
　アルカイダは力を失い、派生した「イスラム国」もシリア、イラクでの支配地域を失ったが、テロの脅威が消えたわけではない。
　オーストラリアの経済平和研究所は、世界のテロの震源が中東から西アフリカに移ったと分析する。統治の弱さ、貧困、気候変動による水や土地をめぐる争い、武器の流入などが背景にある。
　振り返れば、戦乱の長期化で国家機能が弱まり、国際社会から顧みられなくなったアフガニスタンという空白にアルカイダは根を張った。
　武力で組織や拠点をたたくことはできても、テロを生む土壌までなくせない。教育、開発、雇用、貧富の格差や気候変動に取り組み、忘れられた地域をつくらない多国間の協力が必要だ。
　テロの要因は破綻（はたん）国家だけにあるのではない。９・１１を首謀した中心メンバーには高い教育を受け、欧米で暮らした者もいた。いま、欧州では反イスラム感情や排外主義が強まり、若者の極右への傾倒も懸念される。
　法の支配を守り、武力に歯止めをかける。国家の空白と社会の分断を埋める。そのための国際協調を築き直す。それが、９・１１から２５年をかけて得た教訓のはずだ。
